While tools like Google and ChatGPT may offer general legal information, the firm emphasizes that no automated system can accurately assess the unique legal and factual issues that determine compensation under New York law.

With more individuals turning to AI platforms for quick answers, the firm has seen a growing number of prospective clients arrive with settlement figures generated online, often based on incomplete or inaccurate assumptions.

“We recently spoke with someone who relied on an online estimate that assumed zero fault on her part,” said Brett J. Harrison, Founder and CEO of The Harrison Law Group, P.C. “But in New York, fault is rarely that simple. Comparative negligence can dramatically reduce the amount someone may recover. Without a proper liability analysis, those numbers are meaningless.”

New York follows a pure comparative fault system, meaning a person’s potential compensation is reduced by their percentage of responsibility for the accident. An online tool may generate a projected value of $250,000 based solely on medical expenses and reported injuries. However, if evidence establishes that the injured party was 40% at fault, the maximum potential recovery could drop to $150,000 before factoring in litigation risks, expert costs, evidentiary issues, or insurance policy limits.

According to The Harrison Law Group, properly valuing a case requires far more than entering injury details into a digital prompt. It demands investigation, strategic positioning, negotiation experience, and a deep understanding of tort law and insurance defense tactics.

“AI can summarize legal concepts, but it cannot apply decades of courtroom experience to your unique facts,” Harrison explained. “There is a difference between having information and having applied legal judgment. Our clients are not hiring us for a theory; they’re hiring us to seek maximum compensation for their specific case.”

The firm notes that liability disputes, witness credibility, accident reconstruction findings, medical documentation, and insurance coverage limitations all influence a claim’s resolution. In some cases, a claim may ultimately be worth more than an online estimate suggests. In others, liability weaknesses could reduce its value or even lead to dismissal if not handled properly.

For more than two decades, Brett J. Harrison has represented injury victims throughout Long Island and the greater New York region. Admitted to practice in the Southern and Eastern Districts of New York, he focuses on tort litigation involving insurance, automobile accidents, and complex liability matters. The Harrison Law Group works to minimize client fault exposure and build tailored legal strategies designed to maximize recovery.

While online tools may help individuals locate attorneys or learn basic terminology, The Harrison Law Group cautions that determining case value is a legal analysis, not a data entry exercise.

Accident victims are encouraged to consult directly with an experienced New York personal injury attorney before making assumptions about what their case may be worth.

The Harrison Law Group, P.C. Highlights Major Shift in New York Dog Bite Law https://www.hlgny.com/the-harrison-law-group-p-c-highlights-major-shift-in-new-york-dog-bite-law/ https://www.hlgny.com/the-harrison-law-group-p-c-highlights-major-shift-in-new-york-dog-bite-law/#respond Tue, 17 Mar 2026 19:40:46 +0000 https://www.hlgny.com/?p=49787 Melville Dog Bite Injury Attorney Explains How New York’s New Dog Bite Law Protects Victims

MELVILLE, New York – The Harrison Law Group, P.C., a Melville-based personal injury law firm with more than three decades of experience, announces a significant development in New York personal injury law that significantly strengthens the rights of dog bite victims. In 2025, New York’s highest court officially eliminated the long-standing “one free bite” rule, a legal doctrine that previously shielded negligent dog owners from liability if their dog had never bitten someone before.

For years, injured victims faced an unfair legal barrier under prior case law, which required proof that a dog owner knew or should have known that their dog had vicious propensities. Even when owners ignored obvious warning signs or failed to properly restrain their dogs, victims were often left without legal recourse. That has now changed.

The landmark decision in Flanders v. Goodfellow overturned this outdated framework and allows dog bite victims to pursue claims not only under strict liability, but also under traditional negligence principles. This means dog owners can now be held responsible when they fail to exercise reasonable care, even if the dog has no prior bite history.

“This decision corrects a long-standing injustice in New York law,” said Brett J. Harrison, Founder and CEO of The Harrison Law Group, P.C. “For years, I had to tell seriously injured clients that there was nothing we could do simply because a dog had never bitten before. The Court of Appeals recognized that negligence is negligence, whether it involves a car, a dangerous condition, or a dog, and injury victims should not bear the cost of someone else’s carelessness.”

The ruling aligns New York with the majority of states that already allow negligence-based dog bite claims and reflects modern tort principles focused on accountability and public safety. Under the new standard, factors such as leash law violations, unsecured property, ignored signs of aggression, and failure to restrain a dog can now support a viable legal claim.

For dog owners, the decision underscores the importance of responsible ownership, proper training, and compliance with local safety ordinances. For injury victims, it opens the door to meaningful compensation that was previously out of reach.

To help the public understand the impact of this decision, Brett J. Harrison released an in-depth video explaining the ruling, what led to it, and what it means for both dog bite victims and dog owners across New York.

Melville Law Firm Addresses Concerns Over New York’s Judicial Climate https://www.hlgny.com/melville-law-firm-addresses-concerns-over-new-yorks-judicial-climate/ https://www.hlgny.com/melville-law-firm-addresses-concerns-over-new-yorks-judicial-climate/#respond Mon, 16 Mar 2026 19:36:43 +0000 https://www.hlgny.com/?p=49782 MELVILLE, New York – The Harrison Law Group, P.C., a respected personal injury law firm based in Melville, New York, is offering insight into growing concerns surrounding New York’s judicial climate, as recent reports highlight escalating litigation costs and increasing pressure on businesses and insurers across the state.

According to recent findings, New York City has once again been ranked among the nation’s most challenging legal environments, often referred to as a “judicial hellhole.” The designation reflects concerns over excessive legal costs, protracted litigation, and a court system widely perceived as favoring plaintiffs. These conditions contribute to higher insurance premiums, increased operating costs for businesses, and broader economic ripple effects felt statewide.

While much of the discussion focuses on business and insurance interests, the implications of New York’s judicial climate are far-reaching. Lengthy court backlogs and rising litigation expenses can delay resolutions for injured individuals seeking appropriate compensation. For personal injury victims, these delays may translate into prolonged financial strain, uncertainty, and added emotional stress during already difficult times.

Brett J. Harrison, Founder and CEO of The Harrison Law Group, P.C., shared his perspective on the issue, “New York’s courts play a vital role in protecting the rights of injured individuals, but the system must also function efficiently and fairly for everyone involved. When litigation costs spiral and cases drag on unnecessarily, it doesn’t just affect businesses and insurers. It impacts real people who are waiting for justice and financial stability after a serious injury.”

Mr. Harrison emphasized that a balanced judicial system is essential to upholding access to justice while maintaining economic sustainability. Thoughtful reforms that improve efficiency, reduce unnecessary delays, and promote fairness across the board can benefit plaintiffs, defendants, and the legal system as a whole.

As a firm that has represented injured New Yorkers for decades, The Harrison Law Group, P.C. remains committed to advocating for clients within this complex legal environment. The firm closely monitors developments in New York’s judicial landscape and continues to provide strategic, client-focused representation designed to navigate challenges while protecting the rights of those harmed by negligence.

Brett J. Harrison Explains Hit & Run Victims’ Rights and Legal Options https://www.hlgny.com/brett-j-harrison-explains-hit-run-victims-rights-and-legal-options/ https://www.hlgny.com/brett-j-harrison-explains-hit-run-victims-rights-and-legal-options/#respond Mon, 16 Feb 2026 13:09:13 +0000 https://www.hlgny.com/?p=49346 MELVILLE, New York – The Harrison Law Group, P.C., a Melville-based personal injury law firm led by Founder and CEO Brett J. Harrison, has released an educational video addressing one of the most frightening scenarios New York drivers, pedestrians, and visitors can face: being injured in a hit and run accident.

In busy, unfamiliar traffic environments like New York City and its surrounding areas, hit and run collisions are an unfortunate reality for both residents and out-of-state visitors. The video serves as a public service announcement, clarifying what victims should do immediately after a hit and run and explaining how New York’s criminal and civil legal systems intersect to protect injured individuals.

In the video, Harrison explains how fleeing the scene of an accident is a serious criminal offense under New York Vehicle and Traffic Law, with penalties escalating based on the severity of injuries. He also outlines how a criminal conviction can significantly strengthen a victim’s civil personal injury case by establishing fault and demonstrating consciousness of guilt.

Equally important, the video addresses what happens when the driver is never identified. Harrison breaks down the layers of insurance protection available under New York law, including Personal Injury Protection (PIP), uninsured motorist coverage, and the Motor Vehicle Accident Indemnification Corporation (MVAIC). These options can provide vital compensation for medical bills, lost wages, and pain and suffering, but only if strict reporting and filing deadlines are met.

“Hit and run victims often feel powerless,” said Brett J. Harrison, Founder and CEO of The Harrison Law Group, P.C. “What many people don’t realize is that New York law actually provides multiple avenues for recovery, even in these situations. Knowing which insurance applies, which deadlines matter, and how criminal cases impact civil claims can make the difference between seeking compensation and losing that opportunity altogether.”

The video also walks viewers through critical next steps, including seeking immediate medical attention, preserving evidence, identifying potential surveillance footage, and notifying insurance carriers without delay. Harrison emphasizes that early legal guidance is essential, as hit and run cases often involve overlapping insurance policies, procedural requirements, and coordination between criminal and civil proceedings.

Whether someone is injured as a driver, passenger, pedestrian, or cyclist, the firm stresses that New York’s laws are often more favorable to victims than those in other states, but only when the system is navigated correctly. The Harrison Law Group, P.C., draws on its deep familiarity with these scenarios to place each case in the proper legal context and guide clients toward the strongest possible recovery.

Melville Law Firm Praises NY Workers’ Comp for Mental Health Coverage https://www.hlgny.com/melville-law-firm-praises-ny-workers-comp-for-mental-health-coverage/ https://www.hlgny.com/melville-law-firm-praises-ny-workers-comp-for-mental-health-coverage/#respond Thu, 06 Feb 2025 10:16:27 +0000 https://www.hlgny.com/?p=26329 MELVILLE, New York — The Harrison Law Group, P.C., a renowned personal injury and workers’ compensation law firm serving New York for over 30 years, welcomes the groundbreaking legislative changes to New York’s Workers’ Compensation Law. Effective January 1, 2025, it now includes coverage for mental health injuries caused by extraordinary work-related stress, marking a pivotal moment for employee rights and well-being across the state.

Signed into law by Governor Kathy Hochul on December 6, 2024, the new legislation—S.6635/A.5745—broadens the scope of workers’ compensation, treating mental health issues stemming from extraordinary stress with the same seriousness as physical injuries. This shift acknowledges the significant impact of workplace pressures on employees’ lives and represents a critical step in providing necessary financial and medical support to those affected.

Under the revised regulations, the requirement that job-related stress must exceed the usual levels experienced in similar roles has been removed, allowing for a wider range of workers to seek compensation for cumulative or extraordinary stress resulting from their employment. Previously, such claims were largely limited to first responders experiencing stress from work-related emergencies. Now, all employees may qualify, provided the stress is shown to be extraordinary and work-related.

“The inclusion of mental health injuries under workers’ compensation is a strong affirmation of the importance of employee mental well-being,” said Brett J. Harrison, Founder and CEO. “This legislative change modernizes compensation laws and protects workers enduring extraordinary stress on the job by giving them access to support that reflects their challenges. At The Harrison Law Group, we are proud to stand by New York’s workforce and ready to advocate for those impacted by work-related mental health struggles.”

While this expansion means a potential rise in claims, it underscores the need for employers to provide safe, supportive workplace practices that minimize extraordinary stress. Additionally, the new law eliminates the prior requirement of a single stressful event triggering the claim, allowing employees to file for stress caused by cumulative factors over time. However, the determination of what constitutes “extraordinary work-related stress” remains subject to careful review by the Workers’ Compensation Board, supported by expert medical testimony.

The new legislation also significantly aligns workers’ compensation and employee rights by reinforcing protections against emotional distress. However, it retains the principle of “workers’ compensation exclusivity,” which generally prevents employees from suing their employer in court once workers’ compensation benefits for job-related mental health injuries have been granted.

Melville, NY Law Firm Applauds Proposed Changes to Wrongful Death Statute https://www.hlgny.com/melville-ny-law-firm-applauds-proposed-changes-to-wrongful-death-statute/ https://www.hlgny.com/melville-ny-law-firm-applauds-proposed-changes-to-wrongful-death-statute/#respond Fri, 31 Jan 2025 00:30:59 +0000 https://www.hlgny.com/?p=26312 MELVILLE, New York – The Harrison Law Group, P.C. proudly announces its support for the reintroduction of The Grieving Families Act in the New York State Legislature. This important piece of legislation seeks to reform New York’s outdated wrongful death statute, making legal changes to better support families who have suffered the tragic loss of a loved one due to wrongful death.

If enacted, The Grieving Families Act would extend the statute of limitations for filing wrongful death claims, granting families additional time to seek justice and hold responsible parties accountable. Furthermore, the bill proposes an expansion of recoverable damages, including compensation for emotional distress, loss of companionship, and other non-economic impacts that grieving families endure. These updates reflect a long-overdue shift towards a more comprehensive approach to addressing wrongful deaths in New York.

Brett J. Harrison, Founder and CEO of The Harrison Law Group, P.C., expressed his view on the bill’s significance, stating, “The Grieving Families Act is not just a change in the law—it is a recognition of the profound emotional and financial impact that wrongful deaths have on families. By extending the statute of limitations and expanding recoverable damages, this legislation enables grieving families to pursue justice without being constrained by outdated legal frameworks. At The Harrison Law Group, we stand firmly behind measures like this that prioritize fairness and humanity in our legal system.”

The Grieving Families Act represents an opportunity to modernize outdated statutes and give families the remedies they need to cope with their loss. By recognizing emotional and non-economic damages, the bill demonstrates a commitment to valuing human life and the relationships affected by a wrongful death.

The Harrison Law Group, P.C. encourages New York lawmakers to move forward with this significant legislation and urges the community to stay informed about its progress. For families confronting the challenges that come after the loss of a loved one, this bill represents hope, justice, and the promise of meaningful change.

Melville, NY Workers’ Comp Law Firm Supports New Law for Warehouse Workers https://www.hlgny.com/melville-ny-workers-comp-law-firm-supports-new-law-for-warehouse-workers/ https://www.hlgny.com/melville-ny-workers-comp-law-firm-supports-new-law-for-warehouse-workers/#respond Thu, 30 Jan 2025 06:14:02 +0000 https://www.hlgny.com/?p=26315 MELVILLE, New York — The Harrison Law Group, P.C. announces its strong support for the Warehouse Worker Injury Reduction Act, groundbreaking legislation set to take effect on June 1, 2025. This new law, signed into effect on December 21, 2024, upholds the safety and well-being of warehouse workers across New York State.

The law mandates large employers in warehouse distribution centers with at least 100 employees at a single facility—or 1,000 employees across multiple facilities—to create and implement formal injury reduction programs. The purpose of these programs is to identify and mitigate workplace risks that often lead to musculoskeletal injuries. Employers will be required to conduct detailed worksite evaluations, implement engineering and administrative controls to reduce physical strain, and provide comprehensive injury prevention training to their workforce.

This legislation comes at a critical time. Data reveals that warehouse workers in New York face an injury rate double the national average, with one in nine workers in this sector experiencing on-the-job injuries. The Warehouse Worker Injury Reduction Act targets this alarming trend, addressing hazards such as repetitive motions, awkward postures, and fast-paced work conditions—common factors contributing to workplace injuries.

Brett J. Harrison, Founder and CEO of The Harrison Law Group, P.C., expressed his support for the law, emphasizing its long-term benefits for workers and their families. “The Warehouse Worker Injury Reduction Act is a vital step toward protecting the hardworking men and women who keep our supply chains operational. For too long, warehouse workers have labored under hazardous conditions. This legislation provides the safeguards they need—promoting safer work environments and reducing preventable injuries. At The Harrison Law Group, we remain committed to advocating for the rights and safety of all employees. This is a step in the right direction for a fairer and safer New York.”

The law also requires employers to engage qualified ergonomists to assess job tasks, provide solutions to minimize risks, and update their evaluations whenever new processes or risks arise. Workers will participate in these efforts by offering suggestions and insight into addressing workplace hazards—creating a collaborative approach to injury prevention.

With the Warehouse Worker Injury Reduction Act set to go into effect on June 1, 2025, The Harrison Law Group, P.C. encourages workers and employers to familiarize themselves with the law’s requirements to fully comply and create safer conditions moving forward.

The Harrison Law Group Expresses Gratitude for Countless Client Referrals https://www.hlgny.com/gratitude-for-countless-client-referrals/ https://www.hlgny.com/gratitude-for-countless-client-referrals/#respond Wed, 31 Jan 2024 14:48:37 +0000 https://www.hlgny.com/?p=25408 MELVILLE, New York—A pillar of the Harrison Law Group’s success has been prior and current client referrals, which comprise a significant portion of new cases, according to the firm’s founder, Brett J. Harrison.

“From our earliest days, we have made it a priority to ensure every client walks away feeling heard, understood and confident,” says Harrison. “That level of personalized care and commitment has resulted in many referring us to loved ones who find themselves in need of legal assistance.”

The firm credits its philosophy of caring for the whole client, not just their case, with fostering a level of trust that prompts referrals. Staff understand unique circumstances and work diligently to achieve the optimum outcome for each situation.

A shining example of the firm’s commitment to excellence in client relations is a case from several years ago. A client came to the Harrison Law Group after being found at fault in two separate car accidents, though he maintained neither were actually his responsibility. Rather than turning the potential client away, as many other firms had done, the staff took time to understand his perspective. Through diligent investigation and evidence gathering, they were able to determine liability indeed lay elsewhere. With determination, the team argued the client’s case and secured a settlement. The grateful client has expressed his thanks repeatedly over the years, and recently referred his daughter to the firm after she was injured by a careless driver. This very referral exemplifies how the Harrison Law Group’s client-focused philosophy breeds loyalty and referrals from those they have successfully served.

“Referrals are so important to the continued growth of our practice,” Harrison notes. “It is the greatest compliment when someone who was successfully represented then refers members of their family and community to our care. We are grateful for that trust.”

The Harrison Law Group Secures $825,000 for Client Injured in Trip and Fall https://www.hlgny.com/the-harrison-law-group-secures-825000-for-client-injured-in-trip-and-fall/ https://www.hlgny.com/the-harrison-law-group-secures-825000-for-client-injured-in-trip-and-fall/#respond Wed, 06 Dec 2023 13:07:37 +0000 https://www.hlgny.com/?p=22813 MELVILLE, New York—Brett J. Harrison, Personal Injury Attorney, Founder & CEO of the Harrison Law Group, P.C., announces an $825,000 settlement for a 52-year-old nanny, child caretaker, and client injured from a trip and fall off the bottom step of a vacation rental property where she was vacationing.

As she descended the exterior staircase, the client tripped due to uneven steps and sustained a broken right ankle as a result of her fall. She underwent three invasive surgeries including an open reduction internal fixation, a right ankle tendon repair with graft, and a right foot and ankle arthroscopy. In addition to physical injuries, the severity of her situation required her to move away from her home to be closer to her children and family so that they could help her with daily living activities. During the course of litigation, the owners of the property modified the subject staircase without notifying Plaintiff’s counsel, prompting The Harrison Law Group to file a successful spoliation motion against them.

In New York, intentionally or negligently destroying or altering evidence during a legal proceeding is considered spoliation. If spoliation is found, the court can instruct the jury to assume the destroyed or altered evidence would have been damaging to the party responsible.

“I’m delighted that we could reach a fair and just settlement for our client, who has suffered indescribable pain and suffering from this preventable accident,” says Harrison. “Initially there was no offer on the case. Eventually after consistent fighting and legal maneuvering we got defendants to go from a no pay status to resolving the matter right before trial. While we cannot undo what happened, this financial compensation will help cover the costs of her complex medical care and help her rebuild her life. I hope other property owners will take this case as a warning to maintain safe premises and refrain from engaging in spoliation when facing the consequences of their negligence. I’m thankful to our client for reaching out to us for assistance. I encourage anyone who has suffered a personal injury in and around Melville to contact us at (631) 465-9797 to schedule a free case consultation and strategy session.”
